Divorce is one of the most emotionally challenging events anyone can ever go through. It is also one of the most complex and challenging practice areas in family law as it involves many different areas of the law including, child custody, alimony, child support, property and real estate law, and tax law. Because of the legal and emotional difficulties that are inherent in a this area of the law, it is important to have a family law attorney you connect with, treating you with the compassion you need while advocating zealously on your behalf. Attorney Annette Sanchez has the experience needed as a divorce attorney to provide you with superior legal representation while providing the emotional comfort to help you manage the complexities of the divorce process.
There are generally 5 elements to a divorce. Family law practitioners outline the elements by using the acronym P.E.A.C.E.: Parenting Plan, Equitable Distribution, Alimony, Child Support, and Everything Else. If you and your spouse have children born during the marriage, you will need a parenting plan that outlines your respective time-sharing and parental responsibilities. The best parenting plans are specific and leave each party clearly understanding their rights and responsibilities. A court must approve a parenting plan by determining it is in the best interest of the child. Equitable distribution refers to how you and your spouse will divide your assets and liabilities that were obtained during the marriage. Equitable does NOT always mean equal and it is important to understand when an unequal distribution is appropriate. Alimony becomes an issue in a divorce when a spouse is in need of support after the parties are divorced and the other spouse is able to pay. Many factors are considered when awarding alimony, including what each party is receiving as part of equitable distribution. As such, it important to appropriately analyze equitable distribution prior to even considering alimony. Once alimony is determined, then child support must be addressed. And lastly, “everything else”, which can be a variety of things including attorneys fees and court costs.
All the different and complicated elements of family law cases often confuses those going through the process. As your divorce lawyer, it is our law firm’s duty to ease uncertainty by explaining what to expect during each step of the divorce process and what is occurring in your specific case. Our staff will immediately notify you of any developments and will schedule a conference call with the attorney who will explain the legal implications of any developments. Further, Attorney Sanchez will discuss her strategy on pending issues in the case and will ensure the client fully understands and is comfortable with the measures proposed prior to taking any action.
In highly contentious cases, it is important to have a divorce attorney who knows how to balance fighting for your rights and keeping your litigation costs reasonable. The ugly truth, is litigation is VERY expensive, but sometimes unavoidable. As your divorce lawyer, Annette Sanchez will ensure to advocate for what you are entitled to.
